Born in Hamilton, Madison County, New York, Payne attended Hamilton College. He moved to Cleveland, Ohio by 1834. He studied law under Sherlock J. Andrews. He commenced the practice of law. He formed a partnership with Hiram V. Willson. Presidential elector in 1848 for Cass/Butler. A member of the Ohio Senate from 1849 to 1851, Payne ran unsuccessfully for the United States Senate in 1851 and for Governor of Ohio in 1857. He served a single term in the House from 1875 to 1877, representing the 20th District, based in Cleveland.
